which visa and help please for my situation
 
Hi All
Bit of advice please.
My husband and I wish to move to the USA. I am 41 no children. We are happy to consider anywhere in the US.

I have a PHD in Ecotoxicology as well as batchelors and masters in Marine biology (Ecotoxicology is the study of the effects of toxic chemicals on biological organisms, especially at the population, community, ecosystem, and biosphere levels. Ecotoxicology is a multidisciplinary field, which integrates toxicology and ecology) In a nutshell!!

I currently work for an American company in the UK however my boss won’t sponsor a L-1B move sighting there are not opportunities in the US even though they do come up. They stated they sponsor graduates in the US for their PHD.
I have experience in managing staff in laboratories as well as research science, writing risk assessments, writing publications and have over 10 years experience.
Firstly the H1-B route seems difficult due to the amount of people that apply.

Looking at the EB-2 I may qualify but may need assistance from an attorney.
I have changed my CV to a US resume and have found some jobs that appear to have been vacant for some time. These companies have sponsored jobs in the past according to the relevant websites. I will start contacting these companies to see if they would sponsor me, however in the meantime...
Can anyone offer some advise on what is my best option before going to a lawyer ?

Is there other options available to me visas or how to approach companies?
Is there anyone who knows if my field is in demand or knows anyone looking for someone like me?
Am I better applying to a research institute as I believe they are exempt from H1B caps !? I don’t have qualifications in teaching unfortunately

You have several avenues.

A private institution subject to the H-1 cap may be able to bring you in under the O-1 visa.

EB-2 with a NIW seems possible but you need to structure your petition in such a way that you convince USCIS that you are above and beyond the "average" ecotoxicologist.

A more likely but longer path involves coming to a research institution under a H-1B without a cap, securing a permanent position, and then applying for EB-2 with PERM.

You might want to consider university-based labs - and, with your expertise, perhaps forensic science. Good toxicologists (eco- or otherwise) seem to be in demand. Universities are cap exempt!

At the university level, you don't need any. They're usually interested in three things only: 1) you have a terminal degree; 2) you have been published; and 3) you're able to apply for grants to fund your research.

This was the route I was looking at however it just seems to be near impossible with the cap (without research institutions) or even with institutions it’s difficult to convince them from the UK!

Is there any tips to convince these institutions or any that are well known for sponsorship.

Thank you I will be exploring this may struggle to apply my field of science to Forensics but I guess it depends how desperate they are !!. Any advice on how to approach these jobs from outside the US without being dismissed straight away?

The lawyer is the best person for this conversation - you don't need to know before you see them! You might want to seek out someone with O-1 and EB-1/EB-2 NIW experience in scientific fields.

I assume you mean no teaching experience. Many university lab jobs have no teaching aspect. It's the permanent, faculty positions where teaching comes in. If you are aiming for the latter, you would be best served by trying to get a postdoc position in the US.

Yes be good to find someone who was in the same position as me and see how difficult or easy it was with o-1 or eb-2 will see if I can find someone in the forums too!

this is good to hear I will apply for anything toxicology based in the hope even if education/skills don't completely match if they need someone desperately enough hopefully they can see it wouldn't take me long to get to grips with it !!

thats interesting thanks. I have looked for lawyers but some look dubious. Any recommendations ? Is it better to use a US based or UK based one ?

The above can be used anywhere in the text you are quoting.

BTW you have a Bachelor's degree ... there is no 't'
