I am waiting for the approval of my F-1 visa (form I-539: COS from H-1B to F-1). The visa
application was filed in 1999 and the visa dates have been current for last few months. While checking the status of my application in November 2000, the INS officer at CSC (California Service Center) indicated that a decision on the F-1 visa application could be expected anytime, as the case was taken from the shelf and assigned to an Immigration Officer. The F-1 visa application was then re-assigned to another Immigration Officer in first week of Jan 2001. There was no reason given for forwarding the application to another Immigration Officer. Finally, my application was again reassigned to third officer and was told that it would take another 3-4 weeks for decision on it. Is this normal? Has anybody gone through the same experience? INS has not yet asked for additional information as to best of my knowledge the paperwork (I-20, proof of funds, property/family ties in India, other INS documents) was in order. Your thoughts on what might be the cause for forwarding the application from one officer to another to another? (1) What happens is my F-1 visa application is denied? (2) Will I be out-of-status for the period my application was pending? (3) Can I go outside the country (USA) to Canada/India to reapply for F1? (4) If the F-1 visa is not approved, can I apply for H-1 visa directly? |
