valid H-1B status

Default valid H-1B status

Hi.

I have read the following paragraph from the INS Guidance on H-1 / L-1, EAD
and Advance Parole.
"If an H-1 or L-1 holder presents both advance parole documents and
documents of valid H-1 or L-1 status at the port of entry to the U.S., the
INS Inspector should tell the person that she/he is not required to present
the advance parole, and admit the person to the U.S. on the H-1 or L-1
status."
What does "valid H-1" status mean in this case. If I have my H-1B visa
expired, but my I-94 form, which I was originally issued when entering US on
H-1B visa, valid - am I considered to have a valid H-1B status.

The terminology indeed is strange, since somebody who shows up at a POE
can by definition not have a valid status. You need a valid unexpired H-1B
visa and a valid petition for the employer for whom you are actually
working (in other words, the same documents as any other H-1B), plus the
I-485 receipt notice.
