Hi,
Can anyone shed light on the new V-Visa. From what I understand, the spouse of a
Permanent Resident (Green Card Holder) can apply for a V-Visa while waiting for
his/her Green Card application to be completed. Does anyone know what is the waiting
period for such a Visa.
Thanks
PK

Hi,
THIS SHOULD NOT BE CONSTRUED TO BE LEGAL ADVICE. I AM NOT A LAWYER. I DON'T EVEN PLAY
ONE ON TV!
For information on the new "V" visas and other aspects of INS implementation of the
LIFE Act see the INS web site, <http://www.ins.usdoj.gov/graphics/index.htm>.

Yes, look at the website Ed mentioned in his mail. Plus, to generally qualify for a V
visa, the spouse of the LPR must have been waiting for at least three
(3) years from the time I-130 was filed. Best, Nico

Dear PK:
I am an immigration paralegal presently employed by an immigration attorney. The V
Visa was part of the L.I.F.E. Act just recently passed. You must establish that you
have been waiting for your priority date to become current for a minimum of 3 years
in order to be eligible to apply. The V Visa will give the alien relative employment
authorization within the United States while waiting for his/her priority date to
become current.
