Default US working TN1 visa, please help....

I am a professional worker ( Computer specialist with 7+ years exp. )
and haveing a BSc. degree in Computer science alsio Canadian Citizen
and in Toronto for 6 years. Plan to work in US to diverse and expand
my working experience. I am working mostly as contractor but perm job
is okay.

Please give me a clear and up-to-date answers to these questions:

I know I have to find employee in US first to need my skills set but
after that very briefly:

- how will be the process?

- how much time and money employee should spent to take me to their
office?

- Do I need a written job offer from US employee? Any Standard format
we have for TN visa?

- Any other things employee need to send me?

_ What documents I need? Does it any standard list of documents and
format in html or pdf form you can send me?

I am originally from middle east IRAN, everytime I want to go to us
although I am canadian cistizen, they put me in us cutome and
interview, fill form and then when they see things are clean they let
me go... for getting TN1 visa they can be harder to middle easter or
not?

- How much is my chances to get TN1 visa? what is the most important
factors? Can the officer use in his own taste and reject mne because
he doesn't like my face for example?

- Is employee should have minimum kind of criterias to accept as a TN
suppoert from US immegaration perspective? and if it is the case what
is those minimum? ( no. of employee, gross income, ... ? do you have
any list?

- And god forbidden:) If they reject my application, can I have second
chance right away? I heard one Canadaian reject in Niagara border,
went the same dat to Windsor/Detriot border and they accept his
application there, is it possible?

- Does getting lawyer and spend another 2 grand really helps or I can
do everything on my own and almost no difference?

- what is the best online sources for TN or best doc if you have
really appreciate?

Let me see if I can go through this question by question:

The process for applying for a TN involves applying at any Port of Entry (land border or airport). You need to have all of your TN application paperwork with you---job offer letter, degree, proof of canadian citz etc. The adjudication happens the same day.

You do need a written job offer letter from the US employer, but there is no specific format. It needs to have description of company, you and the job offer duties/salary.

There is no set standard of docuemnts you need, and it depends on what TN category you are applying under. However, in general you need your job offer letter, resume, degrees, literature on the company and proof of Canadian citz.

You may be scrutinized in general a little more of you are from Iran, but as a Canadian citz you still should qualify for a TN if you meet all the requirements of the TN category.

If you havea job offer and meet the requirements of a particular TN category, you should qualify. However, there are many specifics and details into each category that may make or break you. The look of you or your face are irrelevant, but specific job duties, criteria etc. are very impoirtant, as well as how the application is presented, and in some cases where it is presented.

There is no minimum number of employees, gross revenues, etc. in order for a U.S. company to sponsor you for a TN. It does need to be a legitimimate job offer and a legitimate company.

If you are denied, you can apply again, but usually going to a different border is a bad idea. (They do not like border shopping) Usually it is best to address the issue at the same border, or speak with an attorney about the denial. However, a denial can be a difficult thing to rehabilitate. You want to do things correctly from the beginning and never have a denial in the computer on your record.

Whether or not you really need an attorney depends on your job offer, credentials and how well you are able to understand the TN category and application process. Many look at it is a risk/benefit scenario and whether they are comfortable doing it on their own. You also need to look at what a denial could mean for your case.

I'm a canadian citizen that used TN-1 twice. I never had any problem. I crossed at the Fort Erie Bridge and all of the immigration officers I dealt with were extremely nice. They said I made their job easy because my qualifications were apparent.

I had all of my original diplomas, letter from employer offering me employment including my skills, degrees, pay, hours etc. I also had a resume. I made copies of everything so they could take and keep whatever they wanted. I also had all of my licenses to practice and everything else related to my field. As long as you have an offer of employment and are qualified and have proof of your qualification don't stress. I never used an attorney and I was fine.
