US visa stamp but don't want to enter US

Default US visa stamp but don't want to enter US

My husband has lived and worked in states as temporary worker and
travelled outside of US few months back and applied for H1B visa at the
US embassy in order to go back to US. He received it stamped after few
months due to the administrative time the embassy required to process
it. Now my husband has found another job outside of US and not
interested in going to US anymore but I would like to keep visitation
option open. I would like to know if we do not want to enter US as
temporary worker then can we apply for visit visa? Also, my husband did
not fly from US when he left and still has I-94 with him, should he
return those at the US embassy?

Yes he should return it, there is an address somewhere tosend it to inthe US. Somewhere in Kentucky if memory serves me right.

you can apply for visitor visa


He should send back his I-94 (if he does not send his I-94 it means USCIS record will show he is still in US.
Your Husband did not fly back from USA; he was supposed to surrender his I-94 when he left USA to any country. It seems to me that your spouse is Indian Citizen and to get his H1 visa stamping he went to Canada or Mexico from US, got rejected, took flight for India from Canada/Mexico and then applied for Visa stamping in US consulate in India and got the Visa after 2-4 months wait and he got the job in India.

He need to explain when he left US and need to send his I-94 with any other evidence that he left US on below adddress:
