US Passport for child born in UK - now living in USA
Hello,
I am looking for some advice please on the process to apply for a US passport for my daughter.
The reason I ask is the certificate costs $1000 but there also looks to be another route of just supplying evidence of her citizenship. Any help would be greatly appreciated

- She was born in the UK in 2018 and we moved to the USA in 2019.
- She has a UK passport
- Father in British in the USA on a perm resident card
- Mother is a US citizen
- She entered the USA on a permanent resident card and I believe she is a US citizen.

A Consular Report of Birth Abroad followed by a US passport application would’ve been the correct procedure. You can apply directly for a passport now from within the US but there would be no permanent record of your daughter’s US citizenship.

As discussed in Matter of Villanueva, a valid US passport is conclusive evidence of US citizenship. That said, I have seen some individual state agencies insist on a certificate of citizenship and refuse to accept a US passport as evidence of citizenship.

As the mother was not born in the US nor has completed the required residence period prior to the birth of the child then please ignore this post.

Your daughter would’ve become a US citizen upon arrival in the US. You can apply now directly for a US passport. A Certificate of Citizenship application is not required but would provide standalone documentary evidence of your daughter’s citizenship.

I know my son did. We applied for a Consular Report of Birth Abroad in London. Followed up with an application for a US passport.

The US citizen parent in this case was herself a citizen by descent and hadn’t met the residence requirements for the child to be a US citizen at birth.

I previously referred to the charts which summarize the prerequisites for acquiring US citizenship at birth. In the case of foreign born children who were not US citizens at birth, there can be automatic acquisition upon immigrating to the US. I have been long amused that such an immigrant visa contains the seeds for its own self destruction where the new green card goes “poof” upon admission to the US. It the arena of “if I was King” I would create a procedure at the ports of entry for immediate issue of a certificate of citizenship instead of a green card.
