Hi

Apologize if this has already been asked

I have always wanted to work in America and now have the opportunity to work there. Im not sure what sort of visa I need and the employer isnt sure what they will need to do either for regards to intern or entry level position.

I forgot to add I have a degree in computing/IT

Im thinking I need to H-1B visa and I-9

Any help appreciated

The employer is the one who does your paperwork for the H1B. All visas are taken for this year, so your employer would have to submit the paperwork in April of 2008 for a start date of October 2008.

Usually a company will have lawyers available to do this kind of work for them.

I have been looking at the J-1 visa, is this any good in terms of working, I know it only lasts for 18 months, If I was on a J-1 could I also apply for the H-1B visa?

J-1 will only work if your potential employer is an official participant in the Exchange Visitor Program. Since they don't seem to know much about visas, maybe they aren't. In addition, some J-1 holders will be subject to a rule that requires them to return to their home countries for at least two years before applying for another status, like H-1.

If your employer gets their application to the USCIS on the right day
(a particular day around April 1 next year), and if their application
is one of the lucky ones to get selected in the subsequent lottery
(chance unknown, perhaps around 50:50) then you'd be able to start in
October 2008 - otherwise, try again the year after.
