Guess what everyone?!!! My boyfriend received an email today stating "A consular has reviewed your case and has made the following decision: Send passport for visa issuance"!!!

Thank goodness!! So it looks like there is still hope for everyone! Good luck!

This was posted by an immigration lawer on March 5th.

While official guidance on this matter has not yet been published by the Department of State, AILA reports that the embassy may already have received this guidance.
The embassy referred to is London.

Hi all,

I wondered if you can shed any more light on your recent experiences, im in a similar boat, I've been stressing out all month reading forums online, this is one of the few which is current, discussing this latest hurdle in getting a visa. The unofficial word is that waivers are required for all applicants with cautions, yet a few of you appear to have just had visas granted? (Happy days for you!) My circs are:
-interview on 26th march
-Foolishly booked flights for 1st may. Not realising the ESTA question.
-Simple caution for 0.3g of cannabis 2005 (18 yrs old)
-Simple caution for common assault 2009 (21 yrs old, drunken mistake, no excuse I know)
-Now 26. Solid job etc. Very remorseful.

Any guidance/insight/support would be massively appreciated.

It's unclear (to my mind) whether actual waivers are required, or if they are simply delaying case reviews in order to first determine where the caution fits into the scheme of things. Either way, though, delays seem to be SOP just now.

Yes - after a 24-30 week wait!


-interview on 26th march

Alas, you are not likely to make the trip.

The assault caution is likely not going to be a major issue; the drug caution, however, likely will be.


Any guidance/insight/support would be massively appreciated.
There's nothing you can do just now, but wait... and wait. If you can, I'd change the flights now and book much later in the year. In the current climate, 5 weeks is an unlikely scenario for completion of your case work - so perhaps best now to resign yourself to not visiting the US.
