Hi there, I'm UK national holding a UK passport with US L1 visa for my work in USA. I recently got married in Kiev Ukraine on advice from people in this forum for how to get my girlfriend, (she is Ukrainian) now my wife to join me in states. I was under the impression that the route to get her here to be with me is easier to get married and then when I apply for greencard to have her noted on the I-485 form rather than apply for fiance visa in UK. anyway, we are married now, is there any way she can join me before I file for greencard? Can I invite her to states with only and L1 visa? If so how and how long can she stay for?

Another issue: how do I go about getting her a UK visa so she is free to travel to and from the UK with me? She has visited UK about 3 times now in the past to be with me over the last 5 years and I have been to Kiev a number of times also.

Any help would be greatly appreciated.

If you're married, she can get a L2 visa at the US consulate with a copy of your marriage certificate and L1 info.

The UK, wouldn't bother unless you had plans on moving back there.

You are married. She is immediately eligible for an L-2 visa. She'll need a copy of your marriage certificate and a proof of your L-1 visa. Research L-2 visa.


No idea... you should probably ask in a forum that deals with visiting the UK.

L-1 is a non-immigrant visa. Once married, she applies for an L-2. She can do that up to the day you are granted immigrant status. [On the cautionary side, one might say until the day before].

Once here, she can file for adjustment as long as the filing is before the grant of your adjustment. Note: in light of the fact that priority dates can backlog, it should be noted that her 485 must be filed while your priority date is current.

thanks everyone, so we can try and get her the L2 visa just now then, but I only have until Jan 22 2012 left on my L1 and the company is in processing to change it to H1B i think......... while they file for the greencard; will this make a difference being on the H1B visa? if so, will she still be granted the L2 until ,my L1 expires ....?? and then what with the H1B??

It will really help if you write in complete sentences; it's difficult to make out your questions.

Your wife is now eligible for an L-2 visa. Since it depends on your L-1, it can only be valid while your L-1 is valid.

If you switch to an H-1B, the dependent visa is called H-4. (note that L-2s may work, with a work permit, but H-4s may NOT work at all)

If your company petitions you to apply for a green card, your spouse will be included and she will get a green card at the same time as you (well, in a perfect world. YMMV)
