Trouble with I-751....time running out!!
 

I need to know a few more things about the I-751. I tried calling the
USCIS Customer Serivce Number, but was unable to reach a live person.
What I needed to know is this....can I send COPIES of our deed,
ins.policy,tax return, and utility bill rather than the originals? I
can get my hands on the originals, but it's going to press us for time.
My husbands conditional residency expires on May 10 so I don't have
that much time to get all this stuff in the mail. Below is what I plan
on sending to INS for "proof". Do you think I will need affadavits
also?

What we have so far is this:
1.Deed to home we both own in both names
2.Auto insurance policy in both names
3.Tax return from 2004 in both names
4.Utility bill in both names
5.Copy of tax return check in both names

That is what I have gathered thus far. On the phone, they said the form
related to filing was the I-485. Am I supposed to file that as well
right now? I had NOT heard about this and thought I was only supposed
to file the I-751.

One more question: Does INS go by the date they RECIEVE the I-751, or
by the postmark? The reason I've been lagging in doing this is because
my husband and I just recently abtained these documents because before,
we were living in dorms as students with absolutely nothing in both our
names...so it has pressed us for time.

Hi:

Copies are fine.

It is date of receipt, but slightly late is a "no harm, no foul" type of thing.

BTW, if push comes to shove, you can file a naked I-751 without any supporting documentation. It will NOT be denied for that reason alone -- you will be interviewed and will have an opportunity to present evidence at that time. [Been there, done that -- for procastinating clients].

Please DO NOT send originals. You will not get them back. Only send
copies and take the originals if you are called for an interview.

Your list looks good. If you have a child together that is the best
evidence. Make copies and fill out the form. It should take that long!

The service centre agent must have misunderstood. ;) No, you do not file the I-485 (you're removing conditions). You were correct, it's the I-751.

Thanks for everyones advice. I don't think it'll be late. If I send it
out on April 18 (this coming Monday), should that put me in the clear
as far as when they recieve it? I will soon be adding a home and life
insurance to the list as both are names are listed as beneficiaries.
That being said, do you think my list is sufficient or should I get the
affadavits as well? Also, when I made a color copy of the back of my
husbands greencard, the lettering on the large metallic black portion
of the card was unreadable. Is this okay? Sorry for all the questions,
I just really don't want to have to drive to Memphis (I live near
Knoxville....it's about a 10 hour drive). Thanks all again!!

You can add everything plus the kitchen sink and still be called for an interview. Sometimes the need for an interview is just a luck of the random drawing for quality control purposes.


I don't see that you have included anything of a personal nature, just financial aspects. Add a few photos from the holidays, anniversaries, parties, vacations, cards and letters from family and friends addressed to you both with envelopes if you saved them, etc. You should be able to show a marriage that is commingled socially and financially, not just financially.

Thank you for reminding me of that! It is a good idea. I have three
photos added and a couple of birthday cards. His conditional residency
expires on May 10, I am sending I-751 out Wednesday the 20th. Question:
Will they get it in time, or should I send it express just to be sure?
Also, I am thinking of adding affadavits to the list. You can see in my
previous posts what I have intended to include. Would affadavits be a
good idea as well? Thanks again!!

No, it doesn't. His card expires, his status does not. He is still a permanent resident with conditions.

Its also a good idea to send this type of thing with some type of delivery confirmation. 3 day priority plus delivery confirmation through the post office will probabaly cost you just under $5. Or you could got with just delivery confirmation which is cheaper. I wouldn't bother with full blown express mail since its a lot more expensive.

We sent all copies I think we had the same stuff as you plus healthcare policies, life insurance policies and some joint accounts. I didn't bother with pictures or afidavites, and they accepted it fine. Of course thats no guarantee just my experiance.

For the avoidance of confusion, if an I-751 has not been submitted then status expires along with the card. Different from being late to renew a 'Green Card' when one is a LPR without conditions.

Understood that in this particular case the person does intend to get the I-751 in on time.

It's Sarah again. Everything is ready and in order to be sent express
tomorrow morning (with pick-up confirmation so we know they have it). I
just had a couple more silly questions. Do they just want the two pages
from the I-751 (pages 4 and 5) ? I was assuming the other three (with
all the rules/regs/etc) was ours to keep....should I be sending those
as well? Also, I stapled the two pages of the I-751, is this okay?
And...one more for the road: I put our check inside an evelope and did
not attach it to the I-751...should I, or is this okay? Let me know!

Hi:

I think that stainless steel sinks are better with CIS than cast iron sinks. But I will admit that I can't speak from experience. Kholer is better than Elkay.
