Traveling with H1-B approved (but not stamped in the passport)
Dear all,
I am from Mexico and here's my current situation. I was working for
Employer A. Employer B offered me a job and I took it, since I have to
move to another state my wife had to quit her job. My H1-B with
Employer B was approved, my wife's H-4 is still pending (we have the
receipt, but not the approval). I need to go to Mexico but I've heard
different versions:
A) That before coming back I need to make an appointment at the US
Embassy in Mexico to get my visa stamped.
B) That if I travel to Mexico or Canada for less that 30 days I can go
and return only showing my Notice of Approval and my wife's visa
receipt.
Could somebofy shed some light?. Thanks in advance.
Bruno

If you travel to Mexico for less than 30 days, you need not obtain an H-1B
visa stamp. I assume that you do have a visa in your passport, and thus
qualify for automatic visa revalidation. See
http://www.nafsa.org/content/Profess...evalid2002.htm.
Your wife's visa receipt is irrelevant to you.
If your wife leaves the U.S., she must obtain an H-4 visa stamp. Automatic
visa revalidation only applies to approved status, not pending status. If
she does apply, her visa receipt is irrelevant (except as a point of
information). She must be prepared to show your H-1B approval and marriage
certificate, and she is well advised to have other items like a copy of the
H-1B petition, a fresh letter from your employer confirming the continuing
employment, and pay stubs.
If she obtains the H-4 approval notice, she can take advantage of automatic
visa revalidation as well.
