Default Travel While H1b transfer pending with just a transfer receipt

Hi all,
I know this question has been asked several times and I have read the
postings to all of them.


I already have a stamped H1b visa in my passport. However, I changed
employers recently and already started working for new employer. Now I
need to travel to india, but i still dont have the approval notice for
the transfer. Only thing i have is the receipt of the transfer.


They are saying 90-150 days and on regular processing..it very well
might be 150 days and I need to travel Dec 26th for a petetion that was

acknowledged Oct13th.

My 90 days are up on Jan13th and I am expected to return back on
Jan20th. I may or may not get approval (someone from US would mail it
to me).


Some pple were saying its ok to just come back using the receipt. Do i
absolutely must have the approval notice or is the receipt ok? I have
the stamp and I know thats still valid for a good year more.

i am the same as you shah- my receipt notice came through on dec 19th
and my lawyer told me that i could travel on it (in fact i already have
left the US to return to UK for vacation).
my lawyer says presenting receipt notice at POE, a copy of previous
i-94 in my passport (the one i just gave up leaving the US), and my
unexpired H1 visa & previous H1 approval for my old employer is enough
for my reentry.
at least i hope this is correct as i will be returning after new year!!
