Transfering H1 issued by a non profit organization

Default Transfering H1 issued by a non profit organization

Can an H-1B visa issued by a public non-profit organization (a state
university), be transfered to a company subjected to the cap? If not,
do I have to wait till the October fiscal year to begin to work for
this company (and just assume like I never had an H-1b). What are my
options?

i know of someone who transferred from a uni without much hussle. don't know the particulars though.

A transfer from a cap-exempt position to a non-exempt position requires
that the cap is open. That would mean Oct. 1 (or possibly whenever they
open the 20K additional H1s for this fiscal year.)
