Default TD Visa Denial

Hi guys:

I hope you can help me out on this.

I was recently employed by an important IT Consulting firm in the
States.

I'm a Mexican citizen and I applied for a TN Visa under the NAFTA.

My Visa was approved immediately, since I had one previously.

But the US Consulate denied th TD for my wife stating that she "falsely
represented herself to be a citizen of the United States" in the past.

According with my wife, this didn't happened that way. This was before
even be married with me.

Officer at the border asked her if she was US citizen to what she
responded "No". Actually, she could not responde "Yes" because she does
not speak any englsh at all.

US Consulate officer not only did denied the TD visa, but he took away
her B1/B2 Visa (which was issued by the US Consulate AFTER what they say
that happened!) and told us that she will not be able to get any kind of
visa in the future!, and that the only thing we could do is to apply for
a visa waiver and expect US DHS to approve it, but that if that happen,
it would only be valid for a certain period of time and would have to
renew it very time.

We were shocked by that. I couldn't believe it. I mean, what they say
didn't happened the way they say. And even if it did, I mean, my wife is
not a criminal. We are trying to persue the American Dream following the
correct way. If we knew we were doing something incorrect, we wouldn't
risk ourselves and lose my wife's B1/B2 Visa.

Can any one help us on pointing us to the right direction on how
to act now?

False claim to U.S. citizenship ( INA 212(a)(6)C(ii) ) is one of the
inadmissibility grounds and it carries a lifetime ban.

..is there any way we appeal, I mean, don't we have the right to defend
ourselves from that acusation?....

what about a waiver?....

What happened exactly? This isn't very clear...

What exactly did happen? Was she denied entry at that time, or did they
find out later? Did she enter on US identification such as a driver's
license? I don't know if this is the case, but US citizens could travel
to Mexico and back entering on a US ID card other than a passport IIRC.
I am not 100% sure about this (a US friend of mine said this is/was
possible), but if she did enter on a US ID card without a Mexican
passport and visa, this would count as claiming to be a US citizen
perhaps as all non-US citizens (in this case Mexicans) must provide a
valid passport for entry?
