SSN - Should we wait?

Default SSN - Should we wait?

My fiance and I went to the SS office about 2 weeks ago. We were told to come back around August 1 and he should be in the system by then. We are leaving for St. John on Aug. 7 and will be married by the time we return on Aug. 19 and will begin filing for his AOS. Should we just wait on the SSN application or go ahead with it?

Sorry to bump my own post, but does anyone know?
If we are going to file before we leave it will have to be tomorrow or Friday for work reasons. I have always been under the assumption that filing before marriage was faster, but would it create unnecessary confusion and/or overlapping paperwork?

I *thought* (but my memory is fuzzy) there were previous discussions on the NG to the effect that you needed to file for the SSN premarriage on a K-1, because the entitlement to an original SSN that a K-1 has disappears upon marriage, and is recreated only after issuance of an EAD as part of the spousal AOS process. In other words, if you're no longer a fiance, you cannot get a social security number based on a work-authorized incidental status. Instead, once married you must wait until you can demonstrate work authorization in order to get an SSN. At least that's my recollection of what was said about K-1s and the SSN timing.

I'm pretty sure there were threads about this in the past few months, but I'm flat out on a deadline and cannot search tonight. Good luck though!

Hi All,


I think the bigger problem is going to be that SAVE and I-94 says
"Ms.Whatever" is a K-1 and you are changing your name to "Mrs. Whoever".
SAVE isn't going to have your married name until you get your EAD in your
married name. Plus I would assume the G-845 would come back not work
authorized due to the marriage killing the K-1 status unless you have the
one year EAD in the married name.

I say get the SSN in the maiden name ASAP and worry about the name change
later. Even if you can't work, there are a lot of other things you can do
once you have an SSN.

Hi Michael

I am not sure I fully understand you. I come here on K-1 on June 3, 2003 and married my fiance on July 3, 2003. We would like to apply SSN card for me. But from what you said, we cannot apply SSN card based on my I-94 because I am not a fiancee anymore? Or should we still apply using my maiden name? Or we can still apply for SSN card using his lastname? (I use his lastname now.) My I-94 is not expired yet (to be expired on Aug 31, 2003) c

Please help.

The story behind this is, we did apply for SSN card by mail sending my passport and all (yeah we misunderstood. I have to apply in person) SSA mailed back my passport and relating docs and they got lost for a month. We just got in back yesterday (Thanks GOD!)

So we want to apply for SSN card for me but we are married now. What should we do?

Hi All,

First you have learned the #1 lesson. Don't ever put your documents in the
mail.

Well the way I see it is your maiden name is going to be listed in SAVE with
your K-1, so it's not going to match your married name. The office is going
to either send off the G-845 to verify your status K-1 or tell you to come
back when you have work authorization in your married name. Now what I'm
not sure about is what BCIS will say about your K-1 status after being
married. You can give it a try and see what happens or just apply in the
maiden name and come back for the name change once you have your 1 year EAD
card in your married name.
