Default Spouse settlement visa with KOL req'd

Hi everyone, my American husband has got a settlement visa issued before the July deadline, he entered the UK mid-September with KOL req'd. We are keen to apply for the indefinite leave to remain asap (cashflow pending!), and am confused with the process. I can't find any posts directly addressing this, any help would be much appreciated.

All your husband need do is book and pass the KOL test. Once he receives his pass certificate (which IIRC happens immediately after the test) he can apply for ILR.

During this time they can, at any point, satisfy the KOL requirement in the UK and apply for Indefinite Leave to Remain (ILR).
*"This time" above refers to the length of time the spouse visa is valid. As long as the spouse visa is still valid, he can apply for ILR.

That's what we did!
Book and do the KOL then applied for ILR.

Thanks so much, it sounds straight forward! Are there any income/job requirements, evidence we have to show etc.?

Thanks for that - reaally helpful. It doesn't seem to specify if you have only entered the UK in the last couple months what documents are needed. Are there any income guidelines, and how do you tackle having 6 letters spanning two years in both your names?

Is it 6 you need with both? I remember we didn't have many with both names on (we bank seperately and don't share the same last name). I remember that we had enough, but I don't think it was 6 with both names. We would have only had:

Council Tax
Car Insurance
Rental Lease

Perhaps we had some from Oz in both our names. IIRC we had 11 documents in all.

This was last March, we arrived with 'KOL Req'd' in 2010 but didn't go for ILR until two years later. (we sprang for the £1300 face to face 'quickie' as we were running out of time on Mrs TB's visa and the regular appts were booked up for the next two mths).

Hi again, sorry to resurrect this thread. We have ordered the life in uk books in preparation for the test, and are renting a house so am working on the pieces of mail (this shouldn't be a problem). But I am concerned about our income level as I am on a government funded tax free bursary of £14,400 and my husband (the American citizen) is just working in a bar (£11,000 a year average) whilst applying for a job in his field. We also have a daughter (8 years who is dual citizen). Have the new guidelines from last year affected what we need to prove in our position. My husband has ILE with KOL required issued in August 2012, we moved to UK at the start of September, thanks so much.

Your husband is under the old rules, so when he applies for ILR it will be under the old requirements.

So if he has ILE KOL Req'd how do we approach the form if it asks to prove we have lived together for the last 2 years in the UK, we only came over 3 months ago but have been married for 9 years and have an 8 year old daughter.

I can't seem to find the income levels for applications before 9th July 2012.

I think you may be able to do a search on immigrationboards.com in the ILR Forum to find most of the answers you need. There are sticky posts at the top of that ILR Forum with timelines for ILR applications too.
