Default Sending 2nd NOA to Embassy To Speed Up

I just got a reply from the London Embassy about sending in the 2nd NOA.

They said that you can't do this - they have to wait for the petition from
the NVC to schedule an interview.

I think that people have been told the opposite before so I don't know if
this is a change in policy since BCIS came in similar to them not doing
provisional files anymore. Just thought I'd let everyone know.

Lindsey

PS - for those also waiting for a reply from London - I sent the email a
week last Friday so it seems to be taking about a week at the moment to get
a response.

A couple of us sent NOA2's to speed things up in Jan, and that worked just fine, however with all the changes In policy I am not sure if this is acceptable anymore,

Due to a change in policy, they will no longer open provisional files at the consulate.

They will still accept the 2nd NOA if you have a provisional file open. Several of us had emails confirming this last week. Do you have a provisional file?

Cheers,

Leslie

I do have a provisional file - I told them this in my email and they still
said it was not possible so wondered if it was something new even if you did
have a file open.

Since I emailed asking about it, our file has been sent from the NVC anyway
so I'm not so bothered about it now - just thought I would let people know
in case they were having to wait quite a while to get through the NVC

Actually Lindsey, I am bothered by it now. The Embassy just replied to us late last week that we could send the 2nd NOA, they also told several others here the same thing. I think someone already sent theirs in to the Embassy because of the Embassy's response. I really wish they could give us all a straight answer. *sigh*

Here's their reply:

> Subject: RE: RE: Visa Enquiry

Leslie

maybe its just a case of different people giving different answers.

Hopefully it will be OK for those that sent it in - if you were told its OK
maybe its worth giving it a go.

At worst surely they'll just wait till they get the case from the NVC to
schedule the interview and give you the 2nd NOA back at the interview

I am not taking any chances. If we decide to send the original 2nd NOA this week, we are going to send a copy of that email and tell them..............."per your email of March 26, 2003....etc" lol

Cheers,

Leslie

This sucks. There is never a straight answer.

Our email said we could send the 2nd NOA just as Leslie's. Andrew has written them every time and has stated every time that our wedding date is May 31. I dont know if this has something to do with it. But we sent our original 2nd NOA. It should get there Tues. I was informed 2 day guarantee is business day... what a rip off!

But I received the NVC letter in the mail today (dated 3/28) that our case will take a week to send to the Embassy. I so glad this came. Its a cushion to help with the original NOA being sent.

Ours was sent from NVC just over a week ago (either 21st or 24th) and I got
interview date today - so they're moving pretty quick at London - you should
hear really soon even if they don't take 2nd NOA into account.

Good Luck!

Lindsey

I am not one to say this too often but...... don't worry Robin, I think you will make the time frame with or without the 2nd NOA being used by the Embassy. Pete's interview letter came today and we are scheduled for April 17th. You are only about two weeks behind us so it's possible just going through the regular channels. Keep the faith. There is an end in sight.

Cheers,

Leslie

Good News for us today. Andrew got an email reply with a interview date of April 10!!!

Also, my wedding dress finally came in....and bad news...my apartment got broken into. Took camcorder, new camera, dvds, etc. All my videos I have ever taken are GONE!! At least we got our interview date...that over powers the loss.

For years now, I’ve been faxing my attorney certified copies of the approval notices to all of the Consulates, and shipping my attorney certified copy sets of the entire I-129f submissions to the Consulates; both with a cover letter from me asking them to open a provisional file (and in those two cover letters, I also list the same data that the BCIS lists in their “cable sent from the Service Center to the Consulate) and dispatch packet 3 to the beneficiary. I do this even when a particular Consulate indicated in the past that they won’t open a provisional file and dispatch packet 3 until they receive the materials from the Service Center (I started doing my “shipping of the complete attorney certified copy set years ago when I read in the “Visa Processing Guide that some posts want a complete attorney certified copy set). I decided early on that it can’t hurt to try, and from what I can tell, it seems to work well.

I’ve had very good luck with some posts that “always first write back saying they won’t open a provisional file (Guangzhou is the one that comes to mind here).

I will be interested in trying this with London again in light of what is being said in this thread.

Good luck with your cases.
