Self Employment ? please answer.

Default Self Employment ? please answer.

I sent my affidavit of support in and receive this....

Sponsors annual household income
[x] The listed income tax documents/IRS statements for the years marked
below are missing/incomplete (if you have lost any of the requested tax
information,contact your local IRS office to obtain a copy)
Schedules are missing for the year(s) [x] 2004 [ ]2002 [ ]2001 [
]2000 They only had 2004 marked...I was self employed and own a
business and didnt file the previous several years......Ihad a Certified
Public Accountant from H&R block to do my taxes... I provided a copy of
the 1040 they filled out but i dont have W2s ....what do othe self
employed people do to provide proof other than my 1040 the tax CPA
provided me....I explained this to the NVC and also supplied me and my
canadian wives assets which came to order $80,000+
Even though im a business owner self employed what can i do since i dont
get regular W2s..i sent a copy of my business bank account,business
license copy,and also an invoice showing i order... what are they askng
now seeing in thier policy it states if your self employed provide proof
of business....also i didnt send them a copy of my schedule c business
the CPA filled out....only a 1040 my tax accountant filled out..It
stated only federal returns...seeing im self employed how do i get a
federal return to send them? and also why did they overlook our
assets... and why didnt they ask for the previous 3 years? only 2004 is
marked....

I can hazard a guess, at least. USCIS is most interested in current employment income, since you are declaring that you are self-employed and do not pay yourself a wage (as in a W-2), then your business net profit is your personal income and would be entered on the IRS 1040 tax form in line 12. Usually, the figure which is entered on the 1040 is computed on Schedule C (line 30) I think. Your letter asks for the Schedule for year 2004 and you stated that you did not provide Schedule C, although this is rather odd, as it should be a part of the 1040 which the accountant files with IRS.

N.B. Federal tax returns ARE the 1040s. State tax returns, usually sent to the Department of Treasury for the respective state, are distinct from federal (IRS) returns.

Call the IRS and request a tax transcript for the years that you do not have W-2s. It's free and it usually takes fewer than 2 weeks.

I believe the issue here is not that he does not have copies of the tax returns, but that he received a request for a Schedule missing from tax year 2004. I would imagine the Schedule they are looking for is Schedule C.

I agree with bio. Schedule C is the backbone of Self Employment and is always required as part of a SE person's I-864.

David,

Form 1040 is only 1 part of most people's tax returns, definitely only 1 part of yours. You need to submit a complete copy of your federal tax return as filed with the IRS, not just Form 1040.
