RIR's denied for IT positions?

Default RIR's denied for IT positions?

My friend working as a software engineer talked to a lawyer who said that
currently the INS is denying RIR's for IT positions (so he suggested
submitting a regular application). Can anyone confirm this?

Not necessarily,

RIR applicattions are based on a pattern of recruitement for a certain
occupation exhibited by a company over a period of time. Since the
conditions in the industry have changed and many people have been laid
off, the DOL has started to ask for evidence that the recruiting
pattern is still consistent at the time an LC application is
processed. Basically, if your company has laid off people of your
profession, or if it's not recruiting them anymore, it has no base for
an LC case.

The RIR will likely be rejected if the company filing for the LC has
laid-off U.S citizens/permanent residents in the past 6 months.
further, it may be delayed depending on the geogrpahic location of the
company ie if it is in bay area -which has the highest unemployment in
the tech sector, they will keep the application in abeyance till the
economy recovers.
