received i-797 and confused

Unhappy received i-797 and confused

hello. i have my soon to be wife in Brasil. she received her first set of papers. but i thought she would get just one set of papers complete with date for interview. my lawyer says she needs to send her ds-2001 and her ds-230 part 1 and 2 to the consulate (rio) in order for them to return another packet with date for interview and the medical papers. her paper work says not to send anything and to wait for them to contact her. Also i was not aware that they need 3 years of w-2 forms and 1040 returns. so i sent off for that today 10/11/04 and i am nervouse she will get an interview before she has my paper work. or that if she does not send the ds forms in that she will not get an interview. also my approval notice says it is valid from 8/25/04 - 12/25-04. what does that mean excatly. does it sound like i am going to hurt the process since it looks like it is going to take 4-5 weeks before she has all my paper work required? sorry if this sounds confusing i thought i was more prepared but apperently not

It sounds like fundamentally, you have a reasonably good handle on
things, no reason to panic. Instead of the W-2s and 1040s, you can also
request a tax transcript from the IRS. It's free and takes only a few days
to get; I think I had mine in about seven days or so. And it is actually
better than a 1040 because it proves that you really filed the return that
you are presenting.

i just want to say thank you for your reply and honestly making me feel a littel better. i took your advice and ordered my transcripts. and called my lawyer and waiting for his reply tommarow. the confusing thing is that it is so different depending onthe country or even just the city where the consulate is. thanks again

Normally, yes, your fiancee sends the checklist back to the US Consulate when she has all the documentation from the list together. Then the Consulate will send her the interivew date. This varies from Consulate to Consulate. You didn't ask your marriage-visa question on the marriage-based visa forum but I would direct you to:

The dates are the dates that the approval of the I-129F are valid for. She must be issued the visa by the 25th of December, 2004 as per your dates. If she is not issued a visa by that date, you, as the US Citizen, can ask the Consulate for an extension. In the case of the Fiancee Visa an originally signed letter stating you are still free to and willing to marriage the beneficiary is required.
