PC came back as 'No Trace', and when submitting the VCU-1 I added a sworn statement, which I was asked about at interview. When I said there was no arrest they didn't probe any further. And nothing mentioned about previous ESTA declaration. So all I can infer is that it has to be worse than my case to be CIMT.
