Default Q.16 - Immigration proceedings / I-130

Hi all,

*Q.16What is meant be the below question?

Has your releative ever been under immigration proceedings?

This is the 2nd time that I apply for IV for my husband, the 1st time the I-130 was approved, he didn't face any immigration problem just we delayed in completing the sponsor docs that's why the case was terminated.

Should the answer be Yes or NO in our case

One more question please
*Q.17 List all Husband/Wife and all children of your relative

Shall I include the name of our children or not?

Thanks
Neri Badr

The answer should be "no". The question is asking whether your husband has ever been in trouble with US immigration.

Yes, include them... since they are his children.

Note the options in question C-16 -- it is a list of the immigration proceedings. Also, there is a later question about other visa petitions filed by the petitioner -- that is where you will disclose the prior application -- which is a good thing given what happened.

Why would you not provide information that is specifically asked for?

Excuse me for interrupting, but based on your husband's previous posts, you should probably find out if your original I-130 (approved) is still valid. It may be that he just needs to restart his visa application.

The $400+ you're spending on another I-130 might be better spent with an immigration attorney who does Egypt cases.
