here is the whole story in brief :

-came to US on H1B1 in 04/2000 i.e.valid till 10/2002.
-got layed off in feb 2001.
-met some one in US got married in oct 2001 .
-wana apply for the work permit and the visa status
change.

can somebody help telling
-what will be the procedure.
-what all we have to do and be prepared of.

under visitor's visa adjustment You and your spouse have to file some forms with the
LOCAL INS office to get you a work permit and on tract to adjustment of your visa
status to that of an immigrant.

As long as they don't leave the country before AOS is granted, then they should be
fine. Overstay is forgiven when marrying a USC. However, an overstay of over 180 days
means you will be denied reentry if you leave the US before AOS is granted.

Thanx for all the info. u guys r great help.i have another ?
me and my wife have almost have 20 yrs of age difference...many ppl told us that INS might come screaming on us about that....!!

You place the cart before the horse. Wait till you meet the INS. In the meantime
behave like you are a married couple. If you think you do not appear to be the norm (
whatever you think it is ) for a married couple, get the younger among you adapt a
lifestyle that ages you very fast: Stop shaving (valid for both, especially great for
the woman), eschew haircut and shampoo, daily lack of sleep, a diet of potato chips,
nachos, cheese and beer, lots of time in front of television on a soft sofa etc....
By the time INS gets to see the two of you, the younger one would start to look older
among the two. You'd be asked to provide new ADIT photos, but what the hell !

My friend out here certainly have a great SENSE of humour...but thats not what we r looking for.we would appriciate if some one can give some advice.
