Reading back through some of the previous posts, there does seem to be some questions, or inferences that cause me to ponder.

I find it difficult to believe that he can not contact his senior management or their Immigration Lawyers, especially in this sort of circumstance.

It is the New Year's weekend after all... post offices, banks, supermarkets, everything is closed.

If I hadn't resigned from my job I would have had the 24th to 5th of January off, so it isn't so hard to believe that the senior management is off on holiday somewhere.

Do you honestly want to check your work e-mail and take work calls on your vacation? I usually forget e-mail exists and shut my phone off for the entire duration of my vacations...

Wow i want your job

I have the luxury of going home after each shift, but never the luxury of being off. Even on vacations i get at least one call a day.

You can have it I'm changing career, but I don't think you would want it if you knew what you were asking for. I am a computer programmer for video games specialising in graphics/animation.

All overtime in the games industry is UNPAID by the way...

The weird thing is that he does not realise that all the testers who are treated like trash (hired on a contract when a game is getting close to release then let go as soon as a game ships) and are probably paid pennies are the ones clocking up the overtime hours because if you stay from 9 a.m to any time later than 8:30 p.m you get a free takeaway.

All these people who have titles like Executive XYZ, Senior Manager, Business Associate, Director of BLAH, etc in the games industry are basically overpaid numpties who tend to be under-educated (because in the games industry you don't need to be educated to be in a high position you just have to be an incredibly good A*** kisser), is ALWAYS terrible at managing people and ALWAYS thinks the solution to a project over running deadlines is to crack the whip and make people put in more hours of UNPAID overtime because we all know that are brains work better when fuelled on takeaway curries and pizza and when we are sleep deprived. Quite frankly I'm sick of it.

Search for "EA Wives" if you don't believe how bad the situation can get...

You've obviously worked at a shoddy games co, not all are like that and not all people in the industry are like that.

OK....I'm going to put forward a thought ...

Could the problem be that the employer has apparently started the I-140 Immigrant Worker petition and in the meantime the poster's son has left the country to get his new L-1 visa without Advance Parole?

The following link seems to imply that the I-485 and Advance Parole can be petitioned for at the same time as the I-140 and that people with L category visas can safely leave and return to the US without Advance Parole as long as the I-485 has been filed.

The links also state "Most Aliens who have pending applications for immigration benefits or for changes in non-immigrant status need advance parole to re-enter the US.

You're right it is pretty shoddy that's why I'm getting out. I suppose EA is pretty shoddy too, considering they are the largest games publisher... But you are right, this is off topic, back to coopa_troopa's son's situation!

ooh....I do believe I-140 was filed in October 2011 but he didn't get Advance Parole before he left

I don't believe that would be the case unless he was classified as an EB1 or maybe EB2 since it is unlikely that the priority date would be current for an EB3 (the most likely EB category that he would be classified as).

I highly doubt that an advance parole is the problem. The DOS wants to revoke the petition due to fraud. Besides, the L1 is a dual-intent classification.
