Dear group!
I sent out I-129f package last month, and now I heard that I needed to
include my fiancee's birth cirtificate (I checked INS website, and it
didn't mention anything about this). Now I'm worried they will send
me a RFE, should I wait for the RFE, or just go a head and submit my
fiancee's birth cirtificate to them? Beside, all the photos of me &
my fiancee together didn't have any date & time on them? Will it be
acceptable?
Is anyone here in the same situation as I am and gets approved?
I'm appreciate your answers.

The INS website does not tell you a lot of things, and more than likely
they will ask for it by sending you a RFE. I don't know which service
center you sent it to, but I know the CSC was sending out a lot of RFE
concerning dated pictures and wanting more proof of a relationship.

I filed the I-129F for the K3 Visa at MSC. I did no include a copy of my husbands birth certficate because it was not mentioned on the instructions.
I hope this was not a requirement because then we will be getting an RFE!
Maybe someone on the forum can clarify.

Ack! I wasn't aware I needed to submit my fiance's birth Certificate either. I knew he would obviously need it for the interview at the US consulate a while down the road after the second NOA. Is this a new change, or did I miss it somehow?

I just checked the INS application procedure again and I didn't see where
they ask for the fiancé birth certificate.
Who suggested you needed to submit it? Be sure you are on the right
page.....
I didn't send one in.
I did what they asked on the application.
See earlier question which is a similar problem dated 2/7/2003 at 2:15 PM.
"uh oh HELP, I spelled my fiancé name wrong on 129F"

You must submit evidence that you are a United States citizen.
If you were born in the United States, submit your birth certificate. If
you were naturalized, submit a plain photocopy of your Certificate of
Naturalization. If you were born outside the United States, submit a copy
of your original Certificate of Citizenship or your form FS-240 [Report of
Birth Abroad of a United States Citizen].

The fiancé's BC is not required with I-129F, but the Consulate will have to
have it at the interview.

You do not need to send the BC of the Fiance with the I-129f application. The
Fiance will need the BC when he/she will go to the interview at the Consulate.

Relax!! You'll be fine!! ![Smile](https://britishexpats.com/forum/images/smilies/smile.gif)
Our I-129F petition was approved Jan 3, 2003, and we did NOT include Mark's birth certificate (only mine, I'm the USC), nor did our photos have dates/times printed on them.
If you are filing the I-129F for a fiancé visa, you DO NOT need to include the foreign fiancé's birth certificate. You are ONLY required to include the USC's birth certificate.
The foreign fiancé's birth certificate (as well as the USC's) is ONLY needed for the K-1 visa interview.
As for the photos, I sent 6 total, but did NOT send originals. Instead, I printed two high-quality photos each on one sheet of paper, and typed a caption under each photo. The captions stated the dates and locations of each photo, and who was in them.
As I said, our petition was approved, no RFEs at all.![Smile](https://britishexpats.com/forum/images/smilies/smile.gif)

well i sent about 27 digital pics, 9 on each sheet of paper and was horrified to realize later that i didn't write anything on them, no date, no place, nothing. i suppose the disney buses and american flags spoke for themselves.
i did send both birth certificates though; my petition was a good two inches thick with emails, phone bills, pics etc. much to my fiance's horror (do they HAVE to have those emails???? isn't that a bit PRIVATE???..funny english people ;-) )
in any event, no rfe's... i was so well prepared from reading these boards and every other visa site possible that i think they granted us approval for the sheer ART of our petition alone! hehe

Thanks for all your help. It's wonderful to know so many people cared
and responded to my email. Regarding the Birth certificate, it didn't
mention anywhere on the website, but I asked some lawyers, and they
said so. That is where I got the information.
Again thanks,
ni

Hi Jenney,
May I ask where did you file your petition? Mine is at service center
in California. I don't know if it makes a difference.
Thanks,
ni
