Hello Everybody,
Here is my situation. My OPT expires on July 1,04. I am getting a new
I-20 on July 2nd to start schooling from August 23, 04. If an H-1b
petition is filed and approved for me before Ausust 23, will it come
with change of status and a new I-94?
Please help,

Hey there,
I don't believe you can count on getting your H1B petition approved before
August 23 this year, as all H1B (65,000 of them) were already approved for
the fiscal year 2003-2004. Any new H1B petition would have to wait at least
until October to be approved. Note that the limit does not apply to H1B
renewal but to only new visas.

They are approved just fine, but with a start date of Oct. 1.

Ok, that's the reason why you would want to apply early, so that you receive
your Visa right on Oct 1, make sense. In any case, Mike can only hope for a
change of status on October 1st, right?

your Visa right on Oct 1, make sense. In any case, Mike can only hope for a
change of status on October 1st, right?
