Default Petition Expiration

I'm trying to get my Fiancée's visa interview scheduled with the Embassy in
Thailand. It's been a battle so far. My question is what happens if she
still doesn't have an interview date by the time our INS Fiancée Visa
petition expires?

The consulate can get it renewed.
It is a common occurrence.
In order for the visa to be valid, it must be issued before the
expiration of the petition.

Thanks. How long does it usually take (I'm using usually very loosely) for
the consulate to renew it? Does it have to go back to the INS or do the
papers just get restamped?

Can you tell me what the struggle was? I am about to apply for K-1
and my fiancee will interview in Bangkok.

BTW, does your fiancee live in BKK?

Mike, the consul can just tack more time onto the approval notice. They don't have to send it anywhere for them to do this, however some consulates might want a written request from the petitioner asking them to tack on more time. That's why I always provide such a letter for the petitioner to sign and send to his (or her) fiancee at the time the petitioner sends the affi pack. That way, the beneficiary will have it to give to the Consul, just in case they want it.

My Fiancée is actually Cambodian, but Thailand is handling all their cases.
I recieved packet 3 and followed all the instructions. Sent back the
checklist of documets as well as the forms they said they needed. After
weekly emails and calling I was then finally told 2 months later that
because she was Cambodian that I would need to send them all the documents
on the cheklist. I was then told another month later that before the
interview date was given, we had to send them copies of her medical exam.
Before they told us we could get the exam done in Thailand just a few days
before the interveiw. It's been a lot of backtracking and policy changes on
their part. I hope it goes much smoother for you.

Thanks. Sorry yours is not going well. I forgot they were handling
Cambodian visas as well.
