Pending N400 and Spouse 's expiring H1-B

My wife and I live in South Carolina. We got married last year. I submitted my N-400
to TSC in June when my 5 years was up. Had my fingerprinted in December at
ASC-Charlotte. I still have not heard anything about interview yet.

My wife's H1-B (six years limit) is expiring at the end of this month. She has never
apply for immigration at all. And has never been out of status before. We feel that
if we apply I-130 under GC would take too long to be useful so we have not done it
yet. We filed a I-539 to change to B-2 to just to delay things a bit but don't know
if we can get it. At least we show we attempt to stay in status.

I just have a few questions:

1) If section 245(i) apply to our case at all if we file I-130 before end of
this month.
2) What is the official status for my wife before there is a grant/deny of the I-539?
3) If there is any problem for I-130/I-485 applicant if out of status?
4) I fax in an inquiry for my N-400 to TSC, no response yet. And the voice menu
response said 500+ days for N-400, is this true?
5) I try the two senators of this state to take a look at my N-400, and both offices
were not very helpful. (It is nice to know that INS treat everyone the same, even
for the senators) or (It is sad to see how little senator's office care about
those "would be" voters) Any suggestion on finding out the N-400 status?
