Default Own a UK Business - Moving under a K1 Visa

Hi all,

I have been searching for an answer with no luck at all and hope someone can help here before I pay to speak to a US Immigration Lawyer.

I currently have a Ltd Company Business in the UK (Myself and my brother are Directors). It is Amazon sales. All goods are sold in UK only. When I move to US on a K1 Visa in January, am I allowed to just be sat in the house and answer customer complaints and queries. My brother will be doing all the labour work of printing out orders, packing and shipping.

I will not be doing any work for US company whilst waiting on EAD/Greencard.

Is this still illegal? Or would I need to remove myself as a Director?

Any assistance would be appreciated.

I suppose we could wonder why you chose the K1 but it is what it is.

K1 is work authorized for the 90 days after that you need EAD. Normally that comes before GC.

The usual issue is that you do not have evidence to show an Employer you are good for the 90 days, but not an issue in this case.

The Tax etc issue is something else, hopefully you have a good accountant.

What Boiler said. You can work for your UK business for the first 90 days in the USA. After that you'll need your EAD.
