Out of status or what - HELP!

Hi,
Our marriage based AOS was filed by our lawyer in August, Charlotte office
still has not responded to 2 inquiry of where the receipt is. Lawyers check
has not been cashed either. We have the FedEx receipt showing that the
Charlotte BCIS mailroom signed for it on Aug 26.
My H-1B runs out in November and will I then be out of status or what is my
status if BCIS doesn't acknowledge our AOS application. I've been married to
my US husband for over 2 years now.

You won't be out of status. What matters is the day you filed. The receipt
would be convenient as proof, but I hear that some local offices do not
even issue receipts (I have no personal experience with local offices). If
they do issue it, it's not going to look anything like an H-1B receipt
notice, probably more like a cash register receipt.
