You need an immigration attorney that is experienced in EB1A cases. On the face of it, you do appear to meet at least some of the criteria. Not only do you need proof of each achievement, book, or whatever, but you also need to show that the achievement, article, or whatever is nationally or internationally acclaimed. For example, your articles in the Times of India might count, but something written in a University newsletter might not be.

Do you have any people in high places that can write a reference letter about you? By "high places" I mean nationally or internationally renowned professors or engineers, for example.

Have you considered the high salary option? If you're paid more than 90% of others in the same job position then that's another you can use. The salary should be relative to wages in your own country, so don't compare US salaries, just those in India.

Good luck.

Each reference letter will be different and although mine have been approved by my attorney, I haven't yet submitted them (or the I-140) yet.

But basic contents should include:
- Who they are
- What their own achievements are (why are they well known)
- How they know you or your work
- Why your work is critical
- (Possibly) how your work will be of benefit in the future
My attorney took out all references to the visa so presumably it's not a good idea to mention it. What it does need is a liberal sprinkling of key words like invaluable, critical, expertise, unique, etc.

Your attorney should review and amend your letters before you send them to be signed by the authors of those letters.

I can't help with any immigration information, but I'm honored to know that you are posting in this forum. I work in computer forensics. Your name came up at the Hackers Halted conference last year for your cybercrime work and penetration software. Best of luck to you!

In consultation with an attorney, it may be a good idea to emphasize the SECOND clause in your question. Also, be aware of the fact that attorney, due to her experience, may want to have those documents revised as to format or content.

Also, it is often not a bad idea to have two or more possible categories going at the same time. A back-up is often a good insurance policy.

Good luck.

"Political correctness." Using the general "his" consistently offends many people. I do not like using "his or her" -- it strikes me as awkward. Having two grown daughters, I gravitated to "her." I have noted that the courts will often alternate in the same document.

I thought the category the OP was going for - absent a Nobel prize - required three categories (out of the possible ten) but maybe you mean something else, since I've used category to mean two different things...

Much like my wife, which confuses the hell out of me when she's talking about more than one person. But the Filipino language doesn't have gender when referring to him/her. Certainly more useful in this respect where a genderless singular version of "them/they" could be used.
