Hi everyone
I have seen lots of different advice on Visa Waivers for CIMT on here but am in need of some advice from anyone who knows...I am a British citizen with a UK passport. In 2004, I was convicted of theft from a shop (aged 19). I am now 25 and a full time university lecturer. Last April 2010 I was given a Waiver of Ineligibility and B1/B2 visa issued. I ended up travelling to South Africa on another conference so did not actually travel on the issued B1/B2 visa and have never travelled to the US in my life. In February 2011 this year my employer asked me to present in a conference in Las Vegas. I agreed and my employer booked return flights departing 2nd May 2011 returning 8th May 2011 (they are not aware of my 1 and only previous conviction). As my existing visa issued in April 2010 expires on 14th April 2011 - On 15th February 2011 I had an appointment at the London Embassy. A waiver was requested by the consular officer and she stated that a review typically takes 1 month and it should (but not guaranteed) be completed before I am due to depart. I am getting worried now as my existing visa expires on 14th April and consequently I need a new visa to travel to the US in two weeks time. Does anyone know or have any advice on the likelihood of the review being completed by then or are the embassy waiting for my existing visa to expire in a few days? Any help and advice would be gratefully received. Thank you!! |

Very old thread now, but waiver timelines have always been one of the hardest things to predict. The fact you'd already received a waiver and visa before would have given me some optimism, but relying on a waiver being approved before a fixed travel date is always stressful.

Why have you reopened a 15 year old thread?

Re: Nonimmigrant Visa Waiver of Ineligibility Application
Hi All,
I am following this thread and have been since my first successful waiver in 2016. My current visa is due to expire in Feb 2028. I now travel to the US at least 4 times a year for trade events so therefore timings have become more critical. I have looked at the spreadsheet and it seems 12-15 months is the likely wait so I had planned an interview for September this year to give some time but I've since read of some having their existing visas void at interview - I have a work trip in October and a family trip in May 2027 which my existing visa cover - is there a risk my existing visa is void at interview? Thanks! |

Yes this happened to me being given the wrong form after being verbally told I was being put forward for a waiver. I also had a panicky few days until the embassy confirmed I had in fact been put forward and the form was just a mistake. I eventually got my visa so sending you good luck as well.
I’m due to fly to NYC using my new visa for the first time on Wed. I am expecting to be sent for secondary screening like every other time I have used a waiver of ineligibility but as I haven’t been since 2024, I just wondered if anyone had any recent experience of using a visa waiver and if the border process had become more onerous? |
Re: Nonimmigrant Visa Waiver of Ineligibility Application
Thanks jools, I will keep monitoring over the next few months before making a call - surprising that they void visas even when a recommendation is made - I would understand if they were denied.
Best, Chris |

Applying for work visa with previous arrest for CIMT
Hi,
I know most people on this thread seem to be applying for visitor visa waivers, but I am wondering if anyone has experience applying for a working visa and declaring a previous arrest for a 'CIMT'. Does the process work the same as a visitor visa waiver? If I am asking this on the wrong thread then I'd appreciate direction to the right one! Thanks. |

Just travelled through JFK last week. Was taken to secondary, kept waiting for around 30 minutes and then asked a couple of standard questions (trip purpose, length etc) and sent on my way. Good luck :) |
