New K3 Visa ?

Does anyone have any information on the new K3 visa and the LIFE act ? Any ideas
whether it will be fasterbetter to get married and bring your spouse on a K3
visa, or not get married, and bring your fiance(e) on a K1 visa and then get
married in America ?

It really depends on three things:
1. When INS ever gets around to getting the application procedure for the k-3 visa in
force, as at this time they are not even allowing any applications for it.
2. what country you are dealing with, as some countries will do direct consular
filing if you marry first.
3. what service center you are using: if you are dealing with Vermont Service Center,
fiance visa is pretty fast.

It is hard to say at this point. I think that congress intended to make the k-3
faster than the k-1...but the way I read the information is you will have to wait
about 6 months for the I-130 to be approved before you can file for a k-3. The INS is

I dont think you have to wait for the I-130 to be approved. If you look at INS's web
site, it specifically states that the spouse can wait *in america* for the I-130 to
be approved. The way I interprete it is, you apply for the I-130, get a receipt for
the application and submit the receipt with your marriage certificate and you're all
set for the K3. Of course the foreign spouse will still have to undergo a medical
exam and an interview and we will have to submit an affidavit of support.
