New H1 while on Administrative processing
 
I am placed under Administrative processing and it looks like its going to take a long time as the company I applied with had some issues with other applicants also. So I think its going to be a long wait time.

Meanwhile, I got an offer from a different company which is a small non consulting company. I am wondering how I would move forward in this case.

What I mean is:

1) Do I ask the company to apply for a new H1B as the quota is still available, or use the existing H1B that I got approval on earlier for the transfer?

2) Will it be a problem if I withdraw my AP application for the visa and go for Visa with the new H1B?

I don't know which one is the right course of action, but if you ended up in AP with one application, you will most likely end up in AP with the second application as well.

Admin Processing isn't due to the type of visa or the company hiring you...it's due to your own name checks, background checks, and security checks.

Thanks Noorah,

I was given a 221g for company details and was told that company needs to be checked out before issuing the visa. As I said, one other person attended at London embassy, where the Consular told that the company has a bad reputation and the person attended for the visa was forced to withdraw the application..... so was sort of confident that the problem is with the company.

Any case lets assume the problem is with the company and not with me, in that case do you think I can withdraw my first application and go for the second one....

There's no need to withdraw the first application. You are allowed to have multiple concurrent visa applications.

Dodgy company then....move on! Please dont say it's some Indian/Chinese consultancy or agency
