Default Need Help ASAP

Hi,
I am Canadian Citizen but born in india. I am currently working on H1-B visa in US company for past 6 years. I am currently on 7th year extension which will expire on June 10, 06. My company already filed for 8th year extension based on my Green Card (labor) filed on 11/01/01.Considering that I am already on 7th year extension for my H1-b status, Can i change employer with TN status? Is it possible at this stage to change the status from H1-B to TN?

Also, My Labor is approved last week and my Current employer is filing for I-140 application. How long is it taking to get I-140 approved?
Based on past 3-4 months history, at what pace the priority dates for I-485 application moving these days. Please advise.

You must already have an employer lined up to get a TN visa. Also, I believe you must apply for it on the Canadian side of the border.

Hi ian-mstm,

I do have an employer at this moment but my concern was that I already have 7 years on the H1. Can I move to TN without having to leave US for 1 year as the TN and H1 are different categories?
Please advise.

Yes... you can file form I-129 and you do not need to return to Canada. It takes about 2 or 3 months. Have a look here: http://www.naftalawfirm.com and click on the TN Visa link.
