Default Need Advice

I have a close Russian friend that has been in the U.S. for 9 years, on
May 5th he was given voluntary deportation until July 7. which will
leave him with a clean INS record. He has an American girlfriend that is
in the process of a divorce, he has know her for 7 years. What is the
best case scenario for him;
1) leave before July 7, and have her apply for fiancé visa for him
2) have the fiancé (girlfriend) go to Russia to marry him.
3) wait till divorce and marry her here, even if it means living under
illegal status until then,.
4) suggestions?

Difficult to understand his situation, probably the word "divorce" you have used it wrongly to explain his problem. To my understanding when a relationship reach the divorce stage that means the story is over!!!.
Are they divorcing because of his deportation or what?

Have your friend tried to extend the voluntary departure? I did and INS gave me 45 days additional. This could buy him some time, but my advise is that your friend should talk with a good immigration lawyer.

I think he means that his friend's girlfriend is in the process of waiting for a divorce from someone else - hence why they have to wait to be married.

Yes, I think also that sometimes the IJ will "delay" things a little if by doing so it allows the respondent time to remedy their situation by lawful means i.e. they will shortly become eligible to AOS as the IR of a USC.

I could be wrong on this but I'm sure I've heard of it happening.
