Hello all,

Hoping someone can shed some light on the naturalisation process for me because I can’t find a complete answer to this specific question anywhere I’ve looked.

I came here on an IR-1, didn’t have to do the AoS because we’d been married over 2 years when I got my GC. We have, however, subsequently divorced. I stayed here, having given up everything in the UK and settled. I have now remarried, again to a USC.

My question is, will my divorce impact my application to naturalise? I’ve been here over 5 years, which seems (from info gleaned via the Googlesphere) to be the main requirement. Is that right, or is there potential for this to go awry?

If you have been a PR for 5 years, you can apply for naturalization. Your divorce won't be a factor.

If you have a clean criminal record, there shouldn't be any issue with your petition for naturalization. You entered the US with an approved immigration visa based on your marriage to a USC and received your green card status at the POE. Since you are divorced from the first wife, you need only wait 5 years from the date you entered the US with the approved visa.

BTW you didn't have to remove conditions (ROC) since your visa was issued after your 2nd wedding anniversary.

I got my USC last year having divorced before my CR1 expired and having to file the I751 as a waiver petition.

It was not even mentioned in the N400 interview.

You'll be fine.

As everyone has noted, dissolution of marriage is not, by itself, a problem in naturalization. That said, there can be issues ancillary to the dissolution which can have an effect. These are usually matters of child support or spousal protective orders.
