Suspect a lot hinges on whether she was able to withdraw entry vs. denial. All a moot point because she's had the fear of CBP-gods put on her and no wish to retry.

Your efforts to commit immigration fraud could have (and may well have) significant consequences for the person you encouraged to enter the US illegally.

I find it utterly bizarre that someone who has gone through an E-2 visa process (of all things!) could be so ignorant to the requirements, let alone jovial about the outcome.

Agreed. The OP's blatant disregard for immigration law could well have a life long effect on the nanny, who it must be said also should have done her own due diligence but was probably assured by her employer that there would be "no problem"......

I would have thought an e2 would involve a lawyer, so possibly op is not liable?

If they used a lawyer for the E-2, it doesn’t follow that they also consulted on their personal situation with their nanny. In fact, it would appear that they did not.
