You have to have been an LPR for 3 years, plus your marriage has to be more than 3 years old. You are allowed to file up to 90 days prior to your 3rd anniversary as an LPR, if your marriage is more than 3 years old at that time.

If you apply today, your marriage won't be a full 3 years old.

Apply after Feb 22, 2013.

Thanks Rene, thought that was likely the case.

Best,
