N-400 Time Outside US question

Default N-400 Time Outside US question

Hi,

I left the US prior to becoming a PR and returned after becoming one. The trip lasted about 170 days. When I fill out N-400, how do I account for this trip? I left a couple of months prior to becoming PR (so did not leave while having a PR status).
Any help would be much appreciated.

Only count the days you were outside the USA while you were a PR.

Thanks. Let's say I left on 20.04 and became a PR on 25.06 and did not return till 5.10. How should I answer the question re: date of departure from US and date of return?

You only count the time you were away while you were a PR... so you were out of the US from 25.06 to 5.10.

It does not matter when you left the USA, if you were not a PR at the time. If you became a PR on June 25, then you start counting your days outside the USA from that date.

I understand your dilema if you attempt to follow the advice that I and others consistenly give - answer the question that is asked. I stick with that advice and note that, since you left the USA more than 5 (or 3, depending on the basis for your application), your days outside the USA during that period will be less than indicated by the dates. This discrepancy deserves explanation so ... attach an explanation. The information you've provided is your posts in this thread is suitable.

No. He was out (left the USA) from 20.04 until 5.10. But, as you say when they ask how many days he was out during the preceeding 5 (or 3) years, he doesn't count from the date he left, he counts from date that was 5 (or 3) years ago.

Jeff,
So, I should include the actual date I left the US (20.04) but in counting the number of days include only those between the date I became a PR and returned to the US (25.06 - 5.10)? And I also should include an attachement explaining how the number of days were determined, correct?

That's what I would do. Answer the questions asked, and when doing so creates an apparent inconsistency explain the inconsistency.

Others have suggested differently - decide for yourself which way you want to do it.

I've already agreed with you on the question of how many days he was out of the country during the period of interest. Thing is, the first question on the line asks when he left the USA, and that wasn't on 25.06.
