Cited wrong post! The one I intended to reply to seemed to indicate the originator of the plan was the USC, whereas it is not apparent that is the case.

Right. He's only made one post (on BE), which includes the phrase "... We can complete the I-140 form to say that I have employment when arrive .... " So he appears to need a visa. Right?

One thing for sure (and a warning to the OP, if you're reading), if you submit an I-140 based on this 'plan', I doubt you will be using an ESTA for travel in the near future.
