Default Merit based promotion

Hey all -

Can a person be promoted to a senior position while his or her
application is pending (or under review) with DOL for Green Card? If
not, is there any way one can avail the promotion without jeopardising
the GC application? Is there any particular stage after which the
applicant can be promoted to the next level?

An application for an employment-based Green Card concerns a job
in the future. While the application is ongoing, the beneficiary
need not work for the company at all, or can work for them in any
capacity for which he is currently authorised. However, when the
application is granted and he wants to work using the GC as his
authorisation, he is required to work at the job described in the
Green Card application. He can change jobs later, but doing so
too soon may lead the CIS to think that the application was
fraudulent or abused.
