Hi, I heard that the spouse will automatically get greencard if they get marry before
apply I-485 ? Assume that they fill in neccessary form. Is that true ? Or they need
to get marry before I-140 ? Thanks a lot. David

Unless you are adjusting status as the parent or minor child of a U.S. citizen, your
spouse will get permanent residency at the same time you do. Actually, all your
spouse has to do is marry you before your I-485 is approved and she will be able to
file an I-485 herself.

My comments are based upon my over 15 years of full time experience as an immigration
attorney. It has not been confirmed by research, and one or more immigration
officials or other attorneys may disagree. This is not legal advice and is provided
on the understanding that no attorney-client relationship is created or intended.
