layoffs, severance packages and H-1B

Default layoffs, severance packages and H-1B

A friend of mine, who is on an H1-B visa, might be fired soon. The company is
offering a severance package, which includes a two month pay. Legally would INS
consider him employed for these two months after the layoff, or is his employment
considered terminated on the day of the layoff? Many thanks for the insight.

His employment ends with the layoff.
