L1B Visa - Degree Required?
 

Hi All,

I currently live in the UK and my company offered me a position in the US, but we seem to have hit a problem, they are stating for me to get the L1B Visa I need a university degree, which I dont have

I've read a few other posts asking the same thing, confirming a degree is not needed, but the most recent one i could find was 2008 - have things changed?

Are there any links I can forward to the visa person in HR to convince them its not needed?

No, you don't. You don't need a university degree for an L- visa.


Have your HR guy talk to the company's attorney. That'll set them straight!

We moved on L visa's with my husbands work. He doesn't have a degree either.

Here is the USCIS link, no mention of degree's being required.

Any thoughts on my chances for L1B approval? I am currently working as a systems engineer for an IT security vendor. We make our own appliances and im involved in the pre-sales process on a technical level - product demos, answering tech questions in meetings. We have multiple, complex products that need to be learnt, so I think this classes as specialised knowledge...

Sounds potentially ok on the face of it but the devil is always in the details. This is one for the attorney.

Other posters are correct that the L-1b category does not, per se, require a degree. However, that said, the facts surrounding the petition may show that a degree is required for that position.

Quite often, the trick in legal analysis is "framing of the issue" or IOW, "what is the question?"

It's been several years, but when my family came over (job transfer for my dad) the lawyer thought it was best to prove that my dad had the equivalent of a bachelors degree. Even though he had over 25 years of experience in the field, and was in upper management, they used his engineering apprenticeship that he started right after secondary school to claim he had the equivalent education of a four year degree. I don't know if that was even necessary, but they wanted to make as strong a case as they could.

So, keeping track of all that training you went through might be very beneficial. But definitely ask your lawyer.
