L1 to permanent residency

Default L1 to permanent residency

Hi,

I have an H1B and the company that I will begin working for shortly will sponsor my green card in the outstanding research category.

We recently found out that my husband may come to US from Britain on an L1 visa. Since he will be on an L1 and he will be part of my petition, are there any problems with adjusting L1 status to permanent residency.

If he has a L1A, it will be faster if he applied for a green card
(even with the ORC). I managed to get my L1A to a green card in about
5 months total (around Nov 2001 it ended)

Steve - I am very interested in the short time it took for you to get from L1 to Green Card. Did your employer sponsor you? And which office did you go through?

Right now I am in US on L-1A and am applying for AOS based on marriage to USC (i.e. my employer is not sponsoring me).

L-1As indeed can often get the GC this quickly for two reasons.

First, the qualifications for an L-1A are the same (actually, even
stricter, I believe) as for an EB-1 GC that does not require a Labor
Certification. So you get to skip that step, which is usually by far the
longest.

And second, since the qualifications are similar, you should already have
the paperwork ready to file a GC petition.

If you file an I-140, then use consular processing, and everything goes
very smoothly, it can indeed be realistic to do it in five months.
Unfortunately, today the processing time for I-140s alone tends to be
longer than five months.
