job offer, but am I out of luck because no H1B's left?
 
Hi,

I'm in the US in the J1 status (no home residency requirement with it,
which is stated on the J1 document). My J1 position ends in a few
months. So after more than 1/2 year of interviews in many places, I
have received a job offer from a regional bank. The HR person of the
bank tells me, we'll pay for processing fees, go to a lawyer, and apply
for H1B with this job offer. OK, so I schedule the immigration lawyer
appointment, but today I read online that the H1B's reached the cap for
this year. Does it mean that I can not work with this job offer and
visiting the lawyer is also pretty pointless? (I obtained my PhD in the
US.)

You company could apply on the 1st April for a 1st October start.

That would unfortunately mean that they hire somebody else now.

I don't think there is an allocation of H1-Bs reserved for people that get their degree in the US. The quota is open for anyone with a degree from an accredited university, regardless of it's location. As far as I know, the only H1-Bs still left are the extra 20,000 available to applicants with Master's Degrees.

I think the Masters have to be from a US institution.

Ah OK, I thought the OP was referring to H1-Bs in general. Thanks for the clarification.

The OP got a PhD in the US. Could he qualify for the quota available to

applicants with Master's Degrees.

Thank you all. I went to a lawyer. H1Bs for applicants like me are
available.
