J1 extension general question...

Default J1 extension general question...

I'm on a J1 visa (with NO 2 yr HRR), My current visa expires end of July, after which time i am allowed to remain in the country for 30 days.

NOW, my J1 is going to be extended until the end of January 2006, so I will be issued a new I-94 with the new D/S date until (01/31/06)... which brings me to my question:

With having the visa extended, would i still have the 30 days available to me when the visa extension expires end of January, so that i am able to stay 'legally' to travel and so on OR would that 30 day period that I'm allowed to stay after my visa expires now fall away due to an extension having been given? (which would suck!)

this probably all sounds more complicated than it actually is, but I don't know how else to ask the question in a simpler way... hope someone can help

First off, are you talking about your visa or your status? Please review
my page at http://www.kkeane.com to understand the difference.

Assuming that you are actually referring to your status, the 30 days
should apply in January. However, it is my understanding that what
counts here is the actual date on the I-94 - it should already include
the extra 30 days. So if your program ends on 01/31/06, you should
request an extension until March 2. You may want to verify this with
your sponsor, though.

Ingo,

why would she even get a new I-94? Usually, the original I-94 has a D/S, which means, she could stay as long as she has a valid DS 2019. With her programm extension she would get a new DS 2019, allowing her to participate in the programm until January 2006. and then, she would still be able to stay 30 days after the end date of the DS 2019.

at least, when I extended my DS 2019, thats how it went.

That is actually an excellent point. I hadn't thought of that. The I-94
may or may not be D/S. If it is, you are right.

Errr.... SHE is actually a HE, thank you!
you are right with your answer. i checked with my program sponsor and i will still be allowed to stay the 30 days at the end of my extension. Although it will not be included/listed on the DS2019 or I-94 apparently.
