I recall a case I had where husband dropped a petition in the mail box and was murdered walking home. Years later, the widow’s case went quite sideways.

I think the point he's making is that you do, legally, have to be in the US when the petition is received, and just because they didn't pick up on it when you filed doesn't mean they won't when the OP filed.

Somewhat cryptically put, I agree, but that is Mr Fs want

What's this based upon? I see no mention on the filing instructions that you have to be legally present when the petition is received.

Not trusting my memory, I just examined the regulations governing both the general requirements for benefits applications and specific requirements for J-2 EAD’s.

CIS follows what us legal types call a mail box rule. If electronic filing should be allowed, the electronic filing is considered receipt. I have NOT looked up to see if electronic filing for J-2 EAD is allowed or it has to be done via paper.
